The Court of Rome, through a recent judgment dated 16 April 2021 (the “ Decision ”) has dealt with two hot topics in the field of copyright: (1) the conditions for copyright protection of a fictional character; and (2) the lawfulness of references (the so-called “ citazionismo ”) to works covered by copyright.
